* harms minors in any way; intentionally or unintentionally violates any applicable local, state, federal or international law; “stalks” or otherwise harasses another; or collects or stores personal data about other Users.

a. you have the power and authority to enter into this agreement;
b. you shall not use any rights granted hereunder for any unlawful purpose; and
c. you shall use the Hollywood Site only as set forth in these Terms of Use.
14. International Use.
Hollywood.com makes no representation that materials on this Hollywood Site are appropriate, legal or available for use in locations outside the United States, or that it is authorized for export from the United States or import into any other country. This Hollywood Site is not intended for distribution to, or use by, any person in any jurisdiction where such distribution or use is contrary to local law or regulation. Those who choose to access this Hollywood Site from other locations do so on their own initiative and should inform themselves about and observe any such laws or regulations and consult a professional if in doubt as to the meaning of any part of the content and services of this Hollywood Site. 15. General Information.
The Terms of Use and the relationship between you and Hollywood.com shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. You and Hollywood.com agree to submit to the personal and exclusive jurisdiction of the courts located within the County of Palm Beach, State of Florida. EACH PARTY WAIVES ITS RIGHT TO A JURY TRIAL IN ANY COURT ACTION ARISING BETWEEN THE PARTIES, WHETHER UNDER THIS AGREEMENT OR OTHERWISE RELATED TO THIS AGREEMENT, AND WHETHER MADE BY CLAIM, COUNTERCLAIM, THIRD PARTY CLAIM OR OTHERWISE. THE AGREEMENT OF EACH PARTY TO WAIVE ITS RIGHT TO A JURY TRIAL WILL BE BINDING ON ITS SUCCESSORS AND ASSIGNS. The failure of Hollywood.com to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms of Use are for convenience only and have no legal or contractual effect or significance. You accept that Hollywood.com has the right to change the content, service or technical specification of any aspect of the Hollywood Site at any time in Hollywood.com’s sole discretion. You further accept that such changes may result in your being unable to access the Hollywood Site.
16. Termination.
Either you or Hollywood.com may terminate the Terms of Use with or without cause at any time and effective immediately. You may terminate the Terms of Use by discontinuing use of the Hollywood Site and destroying all materials obtained from the Hollywood Site. Your use of the Hollywood Site will terminate immediately without notice from Hollywood.com if you, in Hollywood.com’s sole discretion, fail to comply with any provision of these Terms of Use. Upon termination by you or upon notice of termination by Hollywood.com, you must immediately cease all use of the Hollywood Site and destroy all materials obtained from the Hollywood Site and any copies thereof.
17. Ability to Accept Terms of Service.
You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the Hollywood.com website is not intended for children under 13. If you are under 13 years of age, then you are not permitted to use the Hollywood.com website—there are lots of other great web sites for you. Talk to your parents about what sites are appropriate for you.

Content on Hollywood.com is not meant for all audiences. You understand that you will be exposed to User material from a variety of publishers and that Hollywood.com is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User material. You further understand and acknowledge that you may be exposed to User material that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Hollywood.com with respect thereto, and agree to defend, indemnify and hold harmless Hollywood.com, its parent corporation, its subsidiaries, its licensors, and their respective officers, directors, employees and agents to the fullest extent allowed by law regarding all matters related to your use of the Hollywood Site.
19. No Endorsement; Availability; Monitoring
You acknowledge that Hollywood.com does not endorse, evaluate or guarantee any content uploaded by you and you may not state or imply any such endorsement, evaluation or guarantee. Hollywood.com does not guarantee that any content uploaded by you will be made available on the Hollywood Site, whether continuously or at all. Hollywood.com shall have no obligation to monitor any content uploaded by you. However, Hollywood.com and its agents shall have and do reserve the right to monitor any content uploaded by you from time to time for any lawful purpose. Hollywood.com may, without notice to you, remove or block content of any content uploaded by you from the Hollywood Site.
20. Apple Disclaimer.
The following applies to any app related to the Hollywood.com Site that you acquire from an electronic store branded, owned, or controlled by Apple or any affiliate of Apple (“App Store-Sourced Software”):
You acknowledge and agree that these Terms of Use are solely between you and Hollywood.com, not Apple, and that Apple has no responsibility for the App Store-Sourced Software or content thereof. Your use of the App Store-Sourced Software must comply with the App Store Terms of Service. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App Store-Sourced Software. In the event of any failure of the App Store-Sourced Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App Store-Sourced Software to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App Store-Sourced Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by these Terms of Use and any law applicable to Hollywood.com as provider of the software. You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the App Store-Sourced Software or your possession and/or use of the App Store-Sourced Software, including, but not limited to: (a) product liability claims; (b) any claim that the App Store-Sourced Software fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation; and all such claims are governed solely by these Terms of Use and any law applicable to Hollywood.com as provider of the software. You acknowledge that, in the event of any third-party claim that the App Store-Sourced Software or your possession and use of that App Store-Sourced Software infringes that third party’s intellectual property rights, Apple will not be responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim. You and Hollywood.com acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use as relates to your license of the App Store-Sourced Software, and that, upon your acceptance of the terms and conditions of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use as relates to your license of the App Store-Sourced Software against you as a third-party beneficiary thereof. You must comply with applicable third party terms of agreement when using the App Store-Sourced Software. You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
21. Entire Agreement.
These Terms of Use and any and all other terms and conditions of service on www.hollywood.com, and its successor, represent and constitute the entire agreement between you and Hollywood.com regarding your relationship with Hollywood.com, supersedes any prior statements or representations and governs your use of the Hollywood Site.
